Abstract

This research is motivated by the condition that in the midst of widespread local conflicts that require a quick and harmonious resolution, the Mbolo Ro Dampa tradition of customary deliberation in the Bima community has become an alternative mechanism that is effective, efficient, and maintains social harmony..This research aims to answer questions regarding the nature of mbolo ro dampa in resolving disputes, the legal position of mbolo ro dampa in the dispute resolution system in Indonesia, and the ideal legal construction of mbolo ro dampa as a model for dispute resolution based on local wisdom. This research is a normative-empirical legal research using the Philosophical approach, legislative approach, conceptual approach, historical approach, and the sociological approach. This research uses primary data sources as the main data and secondary data as supporting data consisting of primary legal materials and secondary legal materials. The results of the study indicate that, Mbolo ro dampa in dispute resolution is essentially a dispute resolution mechanism based on customary law that places deliberation, togetherness, agreement, peace, and restoration of social relations as the main goal. The legal position of mbolo ro dampa in the dispute resolution system in Indonesia has not been specifically regulated by legislation but is supported by constitutional recognition and is placed as an institutional form as well as a dispute resolution mechanism that originates from the customary values of the community based on local wisdom. The recommendation is that Mbolo Ro Dampa should be positioned as a dispute resolution mechanism oriented toward deliberation, agreement, restoration, and peace, so that it becomes more than just a preservation of customary traditions, but also develops into a legal model responsive to community needs. In its implementation, strengthening Mbolo Ro Dampa requires support from capacity building among customary leaders, documentation of customary law, community oversight, and synergy with village governments and law enforcement agencies.
