LEGAL PROTECTION OF ESTABLISHMENT OF HOSPITAL LICENSES IN INDONESIA ACCORDING TO LAW NUMBER 44 OF 2009 CONCERNING HOSPITALS
A hospital is a health service institution that provides complete individual health services providing inpatient, outpatient, and emergency services to serve the community. Of course, the establishment of a hospital must have a permit from the regional government by an authorized official. In order to provide professional and responsible hospital services, it must fulfill aspects of legal protection for business operators and the community receiving health services. From this description, the problem is formulated: 1. what is the legal protection for business actors who establish hospitals in Indonesia? 2. How are the arrangements for establishing the administration of hospitals in Indonesia according to Law No. 44 of 2009 concerning Hospitals? The research method used is the method of normative legal research or doctrinal legal research, which is a process of finding the rule of Law, legal principles, or legal doctrines to answer the legal issues at hand. Then produce conclusions, namely: 1). Legal protection for hospital business actors is provided through Minister of Health Regulation Number 3 of 2020 Concerning Hospital Classification and Licensing, and Minister of Health Circular Letter Number HK.02.01/Menkes/606/2019 Concerning Postponement of Enforcement of Minister of Health Regulation Number 30 of 2019 concerning Classification and Hospital Licensing. 2). Arrangements for establishing hospitals are regulated through Law Number 44 of 2009 concerning Hospitals, Minister of Health Regulation Number 26 of 2018 concerning Electronically Integrated Business Licensing Services for the Health Sector.
